Defamed online? Five things to do before you reply

A post about you is spreading. What you do in the first few days can decide how strong your position is later.

Finding a damaging post about yourself or your business is upsetting, and the natural reaction is to reply at once. Before you do, take these five steps.

1. Do not reply in anger

A public reply can repeat the allegation to more people, and anything you say may be used later. If a response is needed, it can be planned.

2. Save the evidence now

Posts are edited and deleted. Take screenshots that show the full post, the account name, the date and time, and the web address. Save comments and shares too, since they show how far the post has travelled. Keep the original files, not just copies sent through chat apps.

3. Write down who has seen it

Note anyone who has mentioned the post to you, and any business or opportunity you believe you have lost because of it. This helps show the harm the post has caused.

4. Do not repost or forward it

Sharing the post, even to complain about it, spreads it further.

5. Get advice early

Time limits apply to claims, and a prompt letter of demand is often the fastest way to have a post taken down and an apology published. A lawyer can tell you whether the words are likely to be defamatory, whether a defence may apply, and what a claim would involve.

The aim is usually not a long court case. It is to stop the harm quickly and put the record straight.
